Consumers purchasing products directly from EXVEGA.EU benefit from statutory guarantees. These rights are included with the purchase and apply independently of any additional commercial warranty.
This policy describes the French statutory guarantees. It does not restrict any stronger mandatory protection applicable in your country of habitual residence.
For purchases made directly through EXVEGA.EU, the seller responsible for your statutory guarantee is:
EXVEGA58 Rue de Monceau75008 ParisFrance
Email: support@exvega.euTelephone: +90 850 532 36 86
You may address your claim directly to EXVEGA. You are not required to pursue our manufacturer or supplier instead.
Under French law, EXVEGA is responsible for a lack of conformity appearing within two years of delivery.
For new goods, a defect appearing during this period is presumed to have existed at delivery unless that presumption is rebutted or is incompatible with the nature of the goods or defect.
A product must correspond to its contractual description and possess the functionality, quality and other characteristics reasonably required by applicable law.
Conformity may also concern supplied accessories, packaging, assembly instructions and installation performed under the seller’s responsibility.
Incorrect assembly caused by deficient instructions may therefore be covered.
You may request repair or replacement, subject to the statutory rules concerning impossibility and disproportionate costs.
The remedy must be completed within a reasonable time, no later than 30 days following your request, without significant inconvenience and without charge.
Necessary labour, materials and transport costs are covered. Where applicable, this includes removal and reinstallation or the associated costs.
Any refusal of your requested remedy will be explained.
You may qualify for a proportionate price reduction or termination of the sale where the statutory conditions are met, including refusal to bring the goods into conformity, an unsuccessful remedy, excessive delay or significant inconvenience.
A sufficiently serious defect may justify an immediate price reduction or termination.
Termination is not available for a merely minor defect; EXVEGA bears the burden of establishing that the defect is minor.
Where you choose repair under the French legal guarantee of conformity, the initial guarantee is extended by 12 months.
If you request repair but EXVEGA instead imposes replacement, a new two-year legal guarantee begins when the replacement product is delivered.
Any additional suspension or extension required by applicable law remains available.
Contact support@exvega.eu with:
Your order number or another suitable proof of purchase;
The product name;
A description of the issue and when you noticed it;
Photographs or video, where reasonably available and useful.
Please tell us whether you are requesting repair or replacement.
We may ask for information or inspection reasonably necessary to assess the issue. We will not make photographs, original packaging or product registration an absolute condition of your statutory rights.
If the product appears unsafe, stop using it and contact us before attempting repairs or disassembly.
Where a return or collection is necessary, we will provide suitable instructions and explain the arrangements for the costs covered by the statutory guarantee.
Please contact us before shipping a bulky product so that we can organise an appropriate solution.
The Paris registered office is a correspondence address. Do not send a product there unless we specifically instruct you to do so.
Damage caused solely by misuse, an accident or incorrect handling after delivery is distinct from a lack of conformity.
However, describing a component as a wearing part does not automatically exclude a claim. Premature deterioration may indicate non-conformity.
Each claim will be assessed individually, taking account of the product, its expected durability, the circumstances and the applicable rules of proof.
You may also invoke the French guarantee against hidden defects under Articles 1641 and following of the French Civil Code.
The defect must have existed at the time of sale, have been hidden and render the product unfit for its intended use or substantially reduce that use.
You must establish the hidden defect. An action must generally be brought within two years of discovering it, subject to the applicable twenty-year long-stop period running from the sale.
Where the conditions are met, you may return the product and seek reimbursement or keep it and seek a price reduction. Other remedies, including compensation, remain available where provided by law.
Any additional commercial warranty offered for a product will be described separately, including its guarantor, duration, coverage and claim procedure.
A commercial warranty does not replace, shorten or restrict statutory guarantees.
The expiry of a commercial warranty does not, by itself, determine whether a statutory claim remains available.
Warranty claims are separate from the 14-day right of withdrawal for eligible distance purchases. A defect does not have to be reported within that withdrawal period to qualify for a statutory guarantee.
Nothing in this policy limits mandatory rights relating to product safety, product liability or other remedies available under applicable law.
